The President signed a Presidential proclamation on June 22; suspending the entry into the United States for certain non-immigrant employment based visas:
“Proclamation Suspending Entry of Aliens Who Present a Risk to the U.S. Labor Market Following the Coronavirus Outbreak”
This proclamation takes effect on June 24, 2020 at 12:01(ET) and will remain in place until at least December 31, 2020 (this date can be modified). This same proclamation extends immediately the Presidential Proclamation issued on April 22, 2020 that suspended the entry of certain immigrants into the US.
If you are seeking entry under the following visa categories, the Proclamation suspends the issuance of the following visas:
- H-1B and any foreign nationals accompanying or following to join them;
- H-2B and any foreign nationals accompanying or following to join them;
- J visa and any foreign nationals accompanying or following to join them;
- L visa, and any foreign nationals accompanying or following to join them.
This proclamation only applies to you if your visa is listed above and you are:
- Outside the US on the date of the Proclamation (June 24, 2020);
- Do not have a valid nonimmigrant visa on the date of the proclamation (June 24, 2020).
The Proclamation will not affect:
- Lawful permanent residents (green card holders);
- Spouse or child of a US citizen;
- A person seeking to enter to provide temporary labor essential to the US food supply chain;
- A person whose entry is in the national interest.
